Dear mermaids and pirates, we warmly welcome you to Tsunami Dating. First of all, we want you to know that we truly care about providing a new, pleasant, enriching and caring experience to all our users. We reiterate that this app is offered to mermaids and pirates who are looking for something serious, but who also know how to have fun. That's why we've drawn up the terms of use below, which will let you thrive while keeping a minimum of seriousness when it comes to your general behaviour.

Dear mermaids and pirates, be sure to behave well, or watch out — you'll be leaving the ship pretty quickly. Captain Vinny is very clear about this. Captain Vinny is a captain, not a police officer spending his days disciplining people and moderating profiles. NO.

We want to sail on calm waters, not stormy ones, at all times. We may go through storms now and then, but under no circumstances do we intend to cause disputes.

By accessing or using the Tsunami Dating Services, you agree to be bound by these Terms of Use (the "Terms"), including our privacy policy. You cannot come aboard Captain Vinny's ship without carefully reading these Terms and the privacy policy before creating your account.

By accessing or using the app, you, dear mermaids and pirates, acknowledge that you have read these Terms and accept them without reservation.

We may amend these Terms of Use from time to time. That's why we invite you, dear mermaids and pirates, to check this page regularly. Captain Vinny may notably notify you of any changes in his logbook.

The app is reserved for mermaids and pirates who are at least 18 years old, who have the required legal capacity, who reside in a territory where use of the app is legal, and who have not committed, been convicted of, or pleaded guilty to a crime involving violence or the threat of violence, or related to sexual misconduct.

We are categorical about this. Our app is meant to be a positive and pleasant place for everyone. Captain Vinny's ship is called the Frigate of Love. Love does not include violence or sexual comments, especially toward pirates and mermaids you've just met. Offending pirates and mermaids will be immediately warned and liable to be immediately ejected from our app. We reserve the right to delete your account without notice and at our sole discretion.

We carefully monitor all profiles and will be relentless toward underage mermaids and pirates. We will terminate your account on the spot. If we have doubts about your real age, we may suspend or terminate your account as soon as possible.

By using the app or our Services, you agree to: be fully yourself, respect yourself and respect all pirates and mermaids of all ages; comply with these Terms of Use; comply with all applicable laws, including intellectual property laws and personal information/privacy protection laws; respect all pirates and mermaids both on our app and off it (once you go on a date); treat all pirates and mermaids with respect and dignity; present yourself with respect and authenticity; fill out your profile properly (photos and videos) with your true mermaid or pirate heart; have fun taking part in this experience; show respect when emailing us or when filing a complaint or reporting a "bug"; use a strong password.

By using the app or our Services, you agree not to: lie about anything — the further you stray from your true personality, the longer it will take you to find love; impersonate a mermaid or a pirate; bully, assault, defame, harass, hurt, stalk or mistreat any mermaid or pirate; post or share prohibited content (see below); damage our services or prevent their use by other pirates or mermaids; harm our app, or the servers or networks of Cloud Paradise (a third party Captain Vinny does business with) in any way; use our Services for illegal, harmful, or damaging purposes; use another mermaid's or pirate's account, or share your account with another mermaid or pirate; disclose private or proprietary information you are not authorized to disclose; disclose another mermaid's or pirate's personal information without their permission; solicit passwords or personal identification information from other mermaids or pirates for commercial or illegal purposes; use our app in connection with fraud or a pyramid scheme; solicit money from a mermaid or pirate for any reason whatsoever; upload viruses or other malicious code or compromise the security of our Services; use a bot, a content-scraping or retrieval application, a proxy, or any means to access, retrieve, index, or extract data, or to bypass the navigation structure or presentation of our Services or their content; use our Services to fund a political campaign or influence an election; report a member falsely or misleadingly, or abuse the reporting system made available to you; create a new account after your account has been suspended or terminated.

The main reason Captain Vinny created Tsunami Dating is that he wanted to see change in the interactions between men and women — that is, more harmony and joy, and less pressure and unkindness behind the screen. The playful pirates-and-mermaids concept notably helps change things. Still, some users will always try to behave inappropriately. You can therefore report any abuse or complain about content posted by a mermaid or pirate by writing to us directly at support@tsunamidating.com. It will be important for you to tell us about the abuse or issue in question. You can also report a mermaid or pirate from their profile by tapping the "report" button, or directly within a conversation. We remind you that we reserve the right to investigate any potential violation of these Terms as well as of the rights of pirates and mermaids. Captain Vinny watches over the safety of all members of his ship, which means he holds a certain power of censorship over users who breach the Terms of Use or behave inappropriately. We may in particular censor an inappropriate photo, video, or message on your profile.

Know that Captain Vinny does not spy on you and does not control in any way the words or actions of pirates and mermaids, but he can find out whether vulgar words have been used by some. He can also review a profile that has been reported and decide to terminate it on the spot. You, dear mermaids and pirates, are responsible for your interactions with others aboard the ship. Try to behave well, and everything will go for the best, for everyone's benefit.

You hereby agree to release Tsunami Dating from any liability regarding any claim, demand, loss, damage, right, and action of any kind whatsoever, including bodily injury, death, and property damage, arising directly or indirectly from your interactions with other mermaids or pirates on the app, or from their behaviour.

We want pirates and mermaids to take part in this adventure with joy, to have great conversations, and to enjoy this brand-new experience. To that end, we cannot allow content on our app that: is disrespectful, offensive, or seeks to bully, assault, defame, harass, hurt, stalk, or mistreat any mermaid or pirate; is illegal, or encourages, promotes, or incites any illegal activity (terrorism, child abuse and/or exploitation, money laundering, incitement to hatred or violence, etc.); is defamatory, obscene, pornographic, violent, or liable to undermine human dignity; contains nudity; is insulting, threatening, discriminatory, abusive, or promotes hatred, sexism, or racism; is false; relates to commercial activities, such as job or investment opportunities, solicitation of services, links to other websites, advertisements, sales, contests, etc.; involves sending unsolicited mail; encourages any activity intended to harm a mermaid or pirate; infringes the rights of third parties; was not written by you; may harm the reputation of Tsunami Dating or Captain Vinny; includes the image of another person (mermaid or pirate) without their consent; contains spyware, viruses, corrupted files, worms, or any malicious code designed to interfere with the servers and networks of Cloud Paradise, or with the hardware or equipment belonging to Tsunami Dating.

Dear mermaids and pirates, know that sharing content that breaches these Terms (prohibited content) may result in the immediate suspension or termination of your account.

Dear mermaids and pirates, know that you are entirely responsible for your content. We recommend that you not share content you wouldn't want others to see and that could violate these Terms. Please also refrain from sharing content that could expose you, Tsunami Dating, or Captain Vinny to legal liability.

You are entirely responsible for the content you share and post. You therefore agree to release us from any liability in the event of a claim arising from your content.

Everything that's part of your profile, including your information, your answers to questions, your voice, and your videos, must be accurate and relevant. We decided to include video profiles to "humanize" virtual dating a little more, and to let you better grasp another person's "vibe." It's certainly not easy to be in front of the camera — not even for Captain Vinny — but it's a required part of your profile, which notably helps confirm that you're a real person.

You may not upload or post prohibited content. Make sure not to provide personal contact or banking information. You may provide this kind of information, but at your own risk. Stay cautious. Know that content you post may be seen by other people around the world. You should know that we may monitor or review your content, and that we have the right to delete, remove, censor, or block access to your content at any time and at our sole discretion — though that is not our intention.

You remain the owner of your content. By posting your content, you grant Tsunami Dating a non-exclusive, royalty-free licence limited to operating and improving our Services. You must use our content for lawful purposes only. You may not use, sell, modify, or distribute our content unless we authorize you to in writing. You may not create derivative works from our content, nor extract, disable, analyze, or commercially exploit our content, in whole or in part. You are entitled to use our brand name positively through word of mouth or positive posts on social media.

We reserve all other rights.

You won't be the only mermaid or pirate aboard. You'll interact with other members of Tsunami Dating's crew. Even though you can access member content, it isn't yours — you may not copy it. Member content belongs to the mermaid or pirate who posted it, and it is stored on Cloud Paradise's servers and displayed at that user's request. For the common good of all mermaids and pirates, you can freely report a member's content that appears to contain incorrect, harmful, offensive, false, or misleading information. We're like on a huge cruise ship — if we want to have a good stay, we can freely call out those who threaten the common good and the safety of all mermaids and pirates.

Furthermore, you may not use member content for commercial purposes, whether to send unsolicited emails or to unlawfully harass or threaten other people. We reserve the right to terminate your account if you misuse member content.

Captain Vinny, who operates his sole proprietorship under the name Tsunami Dating, owns all remaining content for the time being. All other content, text, logos, trademarks, sound, artwork, graphic content, user interface, and other intellectual property appearing on Tsunami Dating will soon be owned, controlled, or licensed once Tsunami Dating is incorporated, and will be protected by copyright, trademarks, and other intellectual property rights. For now, all rights, title, and interest in our content belong to Captain Vinny at all times.

You can report the profile of a mermaid or pirate who behaves inappropriately by tapping the "report" button in the dating area. Captain Vinny isn't very patient with this kind of behaviour — in fact, he has zero tolerance for it. He created Tsunami Dating hoping to change users' behaviour behind the screen. Should a mermaid or pirate misbehave, Captain Vinny may issue a warning, remove or delete the content in question, or ban the offending mermaid or pirate, or delete their account.

Tsunami Dating is a dating platform focused on personality, respect, kindness, laughter, authenticity, compatibility, and a sense of community. The app notably offers mermaid and pirate profiles featuring a secret 30-second video to unlock, voice content, and answers to written questions.

Interactions happen through gestures: some stay discreet and reveal nothing to their recipient, while others open a conversation between the two people involved. A mermaid or pirate can always choose not to follow up on an opened conversation — don't be offended by it.

Dear mermaids and pirates, you acknowledge that interactions between pirates and mermaids carry risks, that Captain Vinny does not conduct background checks, and that any date happens at your own risk.

The app does not, however, guarantee that a date will take place, that a relationship will develop, or that a mermaid and a pirate will be compatible.

We keep your data in our database only to make sure you're not a robot. We have no interest in using your data to disclose it to third parties, subject to applicable legal obligations. Inactive accounts may be deleted after a reasonable period. Tsunami Dating uses, retains, and protects your personal information in accordance with Law 25 and PIPEDA.

The app uses cookies and similar technologies for its operation, performance analysis, and personalization. You can manage your preferences in this regard in the app's settings or your device's settings.

Payment terms are displayed clearly. There is a free Pact (Deckhand) and two paid monthly Pacts, Premium of the Seas and King / Queen of the Seas. We decided to offer a paid formula for people who are serious.

In accordance with the Consumer Protection Act (Québec): prices are displayed in the currency of your App Store or Google Play account; consumer rights are respected; you may cancel a subscription at any time from your App Store or Google Play account settings; subscriptions renew automatically on the subscription date, and you will be billed until you cancel.

All purchases made in the app are processed by Apple's App Store or by Google Play: we do not receive or retain any payment card information, even partial. If you have a problem with your subscription or payment method, please email us at support@tsunamidating.com.

To the extent permitted by law, Tsunami Dating, namely Captain Vinny, cannot be held liable for the behaviour of mermaids and pirates, for damages arising from a date or interaction, or for direct or indirect losses related to the use of the app. The app is provided "as is."

You may terminate your account at any time. Tsunami Dating may suspend or terminate an account in the event of a breach of these Terms.

In accordance with Law 25, Captain Vinny is, for the time being, responsible for the protection of personal information.

For the time being, Captain Vinny is in charge of managing privacy incidents, assessing the risk of harm, ensuring the required notifications are made, keeping the incident register, and notifying the Commission d'accès à l'information du Québec (CAI) as soon as possible.

These Terms are governed by the laws of Québec (for mermaids and pirates living in Québec) and the laws of Canada, as applicable.
